New Public Hearing Scheduled and BOS Vote on
Data Centers Zoning Amendment
Postponed to September 10, 2024

JULY 30, 2024: "Due to a regulatory oversight related to new public hearing advertisement requirements effective July 1, 2024, all public hearings scheduled for the July 30 Board of Supervisors meeting have been postponed and will be rescheduled to Sept. 10. The rest of the July 30 agenda – including public comment – will move forward as planned.

In addition, the public hearings that were held at the July 16, Board of Supervisors meeting will also be reheard on Sept. 10. This includes the public hearing on the Zoning Ordinance amendment on data centers, which was scheduled for final decision today.

We apologize to anyone impacted and will conduct a complete review of our public hearing advertisement process moving forward."

REASON FOR THE DELAY
New Virginia State Code requirements increased the timeline to complete the administrative notice requirements and now require the publication within 14 days of the date of the intended action by the planning commission or governing body. Previously, deferrals could be as little as one week after the initial public hearing.

Per the 2023 legislative session's revisions to VA Code Section 15.2-2204, "The changes impact land use cases when the planning commission or governing body defers its decision from the originally scheduled public hearing. These 'deferrals for decision' are commonplace in many northern Virginia jurisdictions, including Fairfax and Loudoun counties. Deferred decisions now require re-advertisement, additional mailed notice and a second public hearing with full public comment."

BACKGROUND
Two Public Hearings on a proposed Zoning Ordinance Amendment to strengthen the standards for data centers were held June 5, and July 16, 2024. After considering the recommendations of the Planning Commission (approve with additional changes) and listening to additional public testimony this day, the Fairfax County Board of Supervisors was scheduled to make the deciding vote on the amendment on July 30, 2024.
